Terms of Service

1. Who we are and what this covers

kiosk.cash provides exchange between supported cryptocurrencies and euros. Payout is available as cash collected at one of our kiosks, cash delivered to an address in an eligible city, or a transfer to your bank account. At the counter we also sell crypto for cash or bank payment. Our registered entity and licence details appear in the website footer.

These Terms form a contract between you and us from the moment you create an order. If you do not accept them, do not use the service.

2. Eligibility

You must be at least 18, legally able to enter a contract, and acting on your own behalf. You must not be resident in, or acting for anyone in, a jurisdiction subject to relevant sanctions, and you must not appear on an applicable sanctions list. You confirm the funds and cryptocurrency you present are lawfully yours and are not the proceeds of crime. We do not accept orders made on behalf of an undisclosed third party.

3. Identification

We are required to identify customers. Depending on the amount, the payout method and our risk assessment, we may require a government-issued identity document, proof of address, or information about the source of your funds, either when you place the order or at the counter before payout. We may refuse or unwind an order if identification is not provided or if the document does not match the person collecting. Section 3 obligations override any other provision of these Terms.

4. Creating an order and the exchange rate

When you create an order we show the exchange rate, our fee and the exact amount you must send. The rate is fixed at that moment and held for the payment window shown on your order, currently 30 minutes.

You must send exactly the amount displayed, on exactly the network displayed. Because several orders may share a deposit address, the amount is what identifies your order, and we may adjust it by a very small amount for that purpose.

If we do not see your deposit within the payment window, the order expires and the rate no longer applies. Funds arriving after expiry are not exchanged at the expired rate; contact us and we will either return them to your refund address or, at your request, re-price them at the rate then available.

5. Blockchain transactions are irreversible

You are responsible for sending the correct asset, in the correct amount, on the correct network, and for providing a refund address you control on that same network. We cannot reverse a blockchain transaction. We cannot recover assets sent to the wrong address, sent on the wrong network, or sent from an exchange account that does not permit refunds. Deposits of an unsupported asset may be unrecoverable.

6. Payout methods

Cash at a kiosk. Once your deposit is confirmed the order becomes ready for collection at the kiosk you selected. Bring your order ID or QR code, your PIN and your identity document. Cash is paid in banknotes, so the euro figure is rounded down to a payable amount and the rounding is shown on your order before you confirm.

Cash delivery. Available only in eligible cities and subject to a courier being available. The delivery window shown is a target, not a guarantee. You must be present and reachable at the address and number you gave. The courier will ask for your PIN and may ask for identification. If nobody is available, the order returns to waiting and we may charge a further attempt or cancel and refund.

Bank transfer. Sent to the IBAN you supplied, in the name you supplied. We do not send funds to a third-party account. Timing depends on the banks involved and is outside our control. An incorrect IBAN may cause loss or delay for which we are not responsible.

7. Your collection PIN

When your order is created we issue a six-digit PIN and show it to you once. We do not store it in a form we can read and we cannot show it to you again. Keep it secret and do not share it with anyone except our staff or courier at the moment of collection.

Anyone presenting your order ID together with the correct PIN and, where required, matching identification may be treated by us as entitled to collect. After three incorrect PIN entries the order is placed on hold and must be reviewed by our staff before it can proceed. If you lose your PIN, contact us with your order ID; we can issue a new one after verifying your identity.

8. Limits, refusal and hold

Minimum and maximum order values apply and are shown before you confirm. Kiosks hold a finite amount of cash and an order may be refused if the amount exceeds what that kiosk holds. We may refuse, delay, hold or cancel an order where we suspect fraud or money laundering, where identification is incomplete, where a sanctions match arises, where we are required to do so by law, or where a technical or pricing error has occurred. Where we are legally prevented from explaining a refusal, we will say only that we cannot proceed.

9. Cancellation and refunds

Because the price depends on a volatile market, the statutory right of withdrawal for distance contracts does not apply once an order has been priced and paid. Before you send funds you may simply let the order expire at no cost.

If we cancel an order after your deposit has arrived, we return the cryptocurrency to your refund address, less the network fee required to send it. Refunds are made in the same asset on the same network; we do not refund in euros. We do not compensate for movements in the exchange rate between deposit and refund.

10. Fees

Our fee is shown on the order before you confirm and is deducted from the amount you receive. Network fees for your deposit are set by the blockchain and paid by you. Bank charges levied by an intermediary or recipient bank are not ours and are not refunded by us.

11. Your obligations

You agree to give accurate information, to use the service only for lawful purposes, not to attempt to circumvent our limits by splitting transactions, not to interfere with or probe the security of the platform, and not to use the service on behalf of anyone who could not use it themselves. Breach of this section is grounds for immediate refusal and may be reported.

12. Liability

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, and nothing affects the statutory rights of a consumer.

Subject to that, our total liability arising from an order is limited to the euro value of that order. We are not liable for indirect or consequential loss, loss of profit or loss of opportunity, for movements in cryptocurrency prices, for delays or failures of blockchain networks or banks, for your own error in supplying an address or IBAN, or for events outside our reasonable control.

13. Complaints and disputes

Contact support@kiosk.cash with your order ID. We aim to acknowledge within two business days and resolve within fifteen. If you are not satisfied, you may refer the matter to the competent authority or alternative dispute resolution body in the country of the branch you dealt with; consumers in the EU may also use the European Commission's online dispute resolution platform.

14. Governing law and changes

These Terms are governed by the law of the country in which the branch handling your order is established, and consumers keep the protection of the mandatory law of their country of residence. We may amend these Terms; the version in force when you create an order governs that order, and changes are published on the site with a revised date.
